Tax-Free IRA Distributions
The tax law signed by President Obama on December 17, 2010, extended the charitable IRA rollover incentive made available in 2006 as part of the Pension Protection Act to extend through December 31, 2011. Under the law, donors more than 70-and-a-half-years old can make tax-free charitable gifts of up to $100,000 from their IRAs in 2011. The gift counts against the donor’s required minimum distribution (RMD). The opportunity to give through your IRA ends when the law expires Dec. 31, 2011.
Example: Jack has $500,000 in an IRAand would like to contribute $25,000 to St. Edward’s University in 2011. Upon hearing of the recently renewed Charitable IRARollover opportunity, Jack directs the custodian of his IRAto transfer this amount not later than December 31, 2011, directly to St. Edward’s as his 2011 gift. He will not be subject to tax on the $25,000 distributed to St. Edward’s. (But neither will Jack deduct this amount because he won’t include it in his taxable income in the first place.)
Giving from an IRA rather than other assets may be especially appropriate if:
- you use the standard deduction rather than itemizing your deductions, OR
- you don’t need all of the minimum distribution you’re required to take from your IRA, OR
- you plan to leave money to charity from you IRA at death anyway, OR
- you would not be able to deduct all of your charitable contributions because of deduction limitations.
