Experiencing any type of discrimination or assault can be extremely stressful. Our goal is to provide a clear, supportive process for the university community. Here’s information on the process.

Filing a Complaint

The Title IX process starts with a complaint. To file a complaint against a student or to communicate a concern about a student who may have experienced sexual harassment, sexual assault, stalking, dating or domestic violence, or hate crimes, complete the Student of Concern/Conduct Referral Form. Different people on campus have different abilities to maintain your confidentiality, depending on their roles at the university. On campus, some resources may maintain your complete confidentiality, offering you options and advice without any obligation to tell anyone unless you want them to. Other resources are expressly there for you to report crimes and policy violations, and they will take action when you make a report to them.

Confidential Reporting

If you desire that details of the incident be kept confidential, you should speak with the Health & Counseling Center’s on-campus counselors or advocates and medical staff or off-campus rape crisis resources, who will maintain confidentiality. Campus counselors and advocates are available to help you free of charge and can be seen on an emergency basis. In addition, you may speak on- and off-campus with members of the clergy and chaplains, who will also keep reports made to them, during the sacrament of reconciliation, confidential

Nonconfidential Reporting

You are encouraged to speak to university officials to report incidents, including the Dean of Students, Residence Life Director, Human Resources Director or University Police Chief. We take incidents of sexual misconduct seriously, and they will investigated and properly resolved through administrative procedures. Reporting is confidential, but information may be shared with other university officials, witnesses and the accused as necessary. The circle of people will be kept as tight as possible to preserve your rights and privacy. The university’s objective is to resolve the matter with care and concern for the best interests of the person filing the complaint, the person against whom the complaint is being filed and the university.

Immediate Response to the Complaint

University officials will respond quickly to ensure student safety by doing any or all of the following:

  • Making a counselor available 
  • Providing access to medical care
  • Issuing a No Contact directive
  • Moving the alleged perpetrator to a different residence on-campus or a different class
  • Changing an alleged perpetrator’s work schedule
  • Moving the reported survivor to a different residence on-campus or to a different class, at the survivor’s request
  • Providing the reported survivor with transportation alternatives
  • Making adjustments to address co-curricular concerns
  • Coordinating academic accommodations
  • Providing options for legal assistance and assistance with visa and immigration concerns
  • Providing advocate options
  • Collaborating with Student Financial Services
  • Providing disability accommodations

Investigation

After the investigation is complete, an on-campus hearing will be conducted. And though legal ideas like guilt and innocence are not applicable, St. Edward’s University never assumes that a student is in violation of university policy. Resolution

The university reserves the right to take whatever measures it deems necessary in response to an allegation of behaviors that fall under Title IX to protect students’ rights and personal safety. Examples may include modification of living arrangements, interim suspension from campus pending a hearing and reporting to the local police. Not all behaviors covered under Title IX will be deemed to be equally serious offenses, and the university reserves the right to impose differing sanctions, ranging from verbal warning to expulsion, depending on the severity of the offense and any mitigating or aggravating facts in connection with the offense. The university will consider the concerns and rights of both the complainant and the person accused of sexual misconduct and other policy violations
