What Should I Expect?

Here’s a visual flowchart of the reporting process for employees when making a complaint of sex/gender harassment, discrimination and misconduct.

The university is committed to a discrimination-free environment and provides resources and services to faculty and staff to address issues involving sex and gender-identity discrimination.

Filing a Complaint

These cases involving faculty and staff are handled by Human Resources, in conjunction with the Title IX coordinator. Faculty, staff and student worker complaints, as well as third-party reports of conduct in violation of this policy, should be made using the Sex/Gender Harassment, Discrimination & Misconduct/Employee of Concern Form, contacting the Title IX Coordinator Lisa Kirkpatrick, Vice President for Student Affairs (512-448-8425), or the Title IX Deputy Coordinator Melissa G. Esqueda, Associate Vice President of Human Resources (512-448-8540).

All complaints or reports should be made as soon as possible after an incident. All individuals are encouraged to report discrimination, harassment, sexual misconduct and retaliation so that prompt effective action can be taken.

Immediate Response to the Complaint

The Title IX Deputy Coordinator will make an initial inquiry and determine whether this policy applies to the conduct alleged in the complaint.

If the policy applies, information will be provided simultaneously to the reporting and responding parties. If appropriate, interim measures deemed necessary to protect the reporting party’s rights and personal safety will be imposed. Such measures may include interim suspension from campus, administrative leave, counseling services, temporary adjustments to work assignment, and reporting to the local police.

Investigation

All reports describing conduct that may be in violation of Title IX, state laws, and university policies will be promptly and thoroughly investigated. Complaints will be handled discreetly, with facts made available only to those who need to know to investigate and resolve the matter. If confidential counseling is desired, employees may contact the university’s employee assistance program, Alliance Work Partners, at 866-348-9368.  

The determination of whether this policy has been violated will be based on a preponderance of the evidence standard, which means the greater weight of the evidence, or, based on the evidence it is more likely than not that a fact is true or not true.

The university prohibits retaliation against anyone for registering a complaint pursuant to these policies, assisting another in making a complaint, or participating in an investigation under the policies. Anyone experiencing any conduct that they believe to be retaliatory should immediately report it to the Title IX Coordinator or Title IX Deputies.

Resolution

Typically, the investigation will be completed no later than 60 days from the date the complaint was filed. If additional time is needed, both parties will be notified.

If a complaint of sex/gender harassment, discrimination and misconduct is found to be substantiated, appropriate corrective action will follow, up to separation of the offending party from the university, consistent with university procedure.

If no violation of this policy is found to have occurred, the reporting and responding parties will each be notified in writing of the outcome by the Title IX Deputy Coordinator.

The responding and reporting parties each have the right to appeal the determination of whether a violation occurred and/or the corrective action imposed (if a violation was found).
